Terms and Conditions of the HUSTLY Advertising Portal (hereinafter also referred to as the "Website or Portal")

These Regulations define the conditions for the provision of services as part of the hustly advertising portal run by the Operator (also referred to as the "Organizer") under the conditions indicated therein. The Operator acts as an intermediary for the Portal Owner, based on relevant internal agreements between the Operator and the owner of the hustly brand
 

General provisions

 

  1. The use of the hustly Portal is free of charge , except for cases where the functionality of the Website or these Regulations so provide.
  2. The subject of the Portal's activity is to provide Users with a space enabling mutual contact, on terms agreed between Users, in which the Operator does not interfere in any way and over which he has no influence. For this reason, Users undertake in mutual relations to respect applicable laws and rules of social coexistence, and any violations thereof by Users do not result in the Operator's liability.
  3. The Operator is the entity authorized to verify registered Users and takes actions to prevent any irregularities. For this reason, the Operator enables anonymous reporting of violations as part of the signaling procedure, as referred to later in the Regulations.
  4. The portal allows you to set up User accounts, as well as view its content without the need to register an account. Registered users have access to the full functionality of the Portal.
  5. The Portal is intended for adults who are over 18 years of age or are of legal age within the meaning of the law of the User's place of residence or stay, if such law provides for the requirement of age over 18 and have full legal capacity, and the Portal reserves the right to verify this requirement for registered Users.

 

User Responsibilities

 

  1. By accepting the Regulations and by visiting the Portal, the User confirms that he is an adult within the meaning of the law applicable to him, and this law does not prohibit the User from accessing the content published on the Portal, which may contain elements of nudity, erotica and broadly (commonly) understood content for adults.
  2. The User undertakes to use the Portal only personally, not sharing his access with other people - regardless of whether he registers the User's account or not.
  3. Each User may have only one User account within the Portal.
  4. By accepting these Regulations, the User declares that he has read the legal requirements applicable to his place of residence or stay regarding the use of the content presented on the Portal via the Internet and undertakes to comply with them. Violations of these requirements by the User may not constitute a basis for encumbering the Organizer with any right or obligation, as well as any criminal, penal -fiscal or administrative sanction. In the event of a breach of these obligations by the User, resulting in the initiation of proceedings against the Organizer, the User shall indemnify the Organizer from any liability in terms of causation, as far as it is permitted by law. This exemption from liability applies to both the Organizer and any third parties that are related to the Organizer in any way.
  5. Users do not have the right to copy, reproduce or otherwise process content published on the Portal that is not their exclusive property. You may not create any derivative works from this content.
  6. Registered users undertake to publish content, graphic and audio-visual materials that are their sole property or to which they have exclusive rights. Violation of these obligations will lead to the blocking of the User's account and may give rise to legal liability towards the violator. In the case of publishing photos or video materials, the User undertakes to publish only his own materials. Before publishing photos or other materials on the Portal, the Organizer reserves the right to verify them. The content may not contain vulgar or scandalous information, and the Organizer is entitled to moderate them if they violate the standards of the Website, the law or the principles of social coexistence.
  7. The User is not allowed to post content containing links to other websites or to software or active links leading "outside".
  8. Photos containing pornographic content or violating the law or the rules of social coexistence will be removed by the Organizer and the publication of such content may lead to the blocking or deletion of the User's account.
  9. Users have no right to interfere in any way with the structure of the Portal, its source code and functionalities.
  10. Users are obliged to use the Portal and contact other Users in a manner that ensures respect for the law applicable to their place of residence or residence.
  11. The data collected on the Portal are the property of the Operator and may not be used by the Users for the User's own purposes without the Operator's consent expressed in writing under pain of nullity.
  12. Rights to the content made available on the Portal, in particular copyrights, the name of the Portal, trademarks of the Portal as well as producers and bidders who may present their marketing content on the Portal, including, among others. photos, graphic elements, descriptions of the presented goods or services are protected, and their use in any way without the consent of the Seller or other authorized entities is prohibited.
  13. By posting any content or materials on the Portal, the User grants the Organizer a non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute this content in any existing or future media. Revocation of the license will lead to the expiry of the User's account without the right to return any funds paid to the Organizer. The User grants the Organizer the right to grant further licenses and the right to pursue claims related to copyright infringement to the materials published on the Portal.

 

 

Removal or blocking of the User's account

 

  1. The Organizer has the right - at its discretion - to temporarily block the User's account or delete it in the following cases:
  1. Becoming a reasonable suspicion or obtaining information that the User does not meet the requirements of these Regulations.
  2. Violation by the User of the law or the provisions of these Regulations.
  1. The Organizer has the right to refuse to register the User's account (preliminary verification) in the event that during the verification process it has doubts as to the User's compliance with the requirements of the Regulations or legal provisions , and the evidence provided by the User does not contribute to clarifying these doubts.
  2. The User's account is temporarily blocked for the duration of the investigation, not longer than 7 days.
  3. In the event of a justified blockade or justified deletion of the User's account, the User is not entitled to a refund of any fees paid to the Portal, regardless of their form.
  4. In the event of unjustified blocking or deletion of the User's account, the regulations resulting from the complaint procedures shall apply.

 

Services provided by the Portal and payments

 

  1. The Portal provides the possibility for the Users to use the advertising space and to add advertisements within it, the content of which is edited only by the Users. However, the organizer retains the right to moderate them.
  2. Registered Users can use additional functionalities of the Website, such as: promoted ads, awards, verified ads, chat, calendar, comments or statistics. Some of these functionalities may involve the need to make payments to the Organizer in the form and amount indicated on the Portal. The price for the service is always known to the User before purchasing the service.
  3. Additional functions may require - in addition to payment - also additional User activity. For example, in the case of verified profiles, to obtain such status, the Organizer may require verification of identity documents or other information for the purposes of this process.
  4. Users who decide to use the paid functions of the Portal agree to start providing the service before the deadline to withdraw from the contract and therefore waive this right.
  5. Unregistered users have the right to browse the Portal, without additional functions.
  6. Voucher payments are made based on an external service provider. The sum paid using the pre-paid voucher after its implementation will be visible for use on the User's account for the time during which the account will be active. Blocking or deleting an account will lead to temporary (blocking) or permanent (deletion) unavailability of funds. In the event of a justified blocking or deletion of the account, the User is not entitled to a refund.
  7. After choosing a service for the price indicated on the Portal, the sum of available funds on the User's account will be reduced by the price of the selected and approved service.
  8. Payment for services is based on an external payment system operator. The Portal Operator does not provide its own payment methods and is not responsible for the handling and implementation of the payment process. The regulations and policies of third parties responsible for carrying out such a process apply to the payment process.
  9. Removal of the User's account is also possible by the User - in this case, the contract for the provision of access to the Website expires, and any funds not used by the User are not refundable.

Disclaimers

  1. The Operator takes due care to ensure that the content presented on the Portal reflects reality, while being compliant with the law and the principles of social coexistence. However, due to the dynamics of the operation of the Portal and the activity of Users, the Operator shall not be liable to Users for unreliability of content posted by other Users.
  2. The Operator is not responsible for technical interruptions in the operation of the Portal caused by external factors or necessary technical works, however, it will make every effort to ensure that such works are carried out as soon as possible.
  3. The Operator shall not be liable, to the extent that it is legally permissible, for actions or omissions of Users that are inconsistent with the law or these Regulations.

Complaints

  1. If the User finds that the services provided by the Operator are defective, the User is entitled to file a complaint via e-mail sent to the following address:

  2. The operator responds to the complaint immediately, no later than within 14 calendar days from its submission. In the case of requests by the User who is a consumer, if the Operator has not responded to this request within fourteen days, it is considered that the request was justified.
  3. If the complaint is accepted, the Operator will reimburse the User for the costs related to the paid service to which the reported defect relates. However, the Operator is not responsible for the User's lost benefits.

 

 

Jurisdiction

In the event of any disputes, they will be held on the basis of the law applicable to Hong Kong, and the competent authority for their resolution will be the Hong Kong International Arbitration Center (HKIAC) based on the rules of this court.

 

Whistleblowing policy _

The operator takes active measures to prevent the use of forced situations, trafficking in human beings or sexual exploitation. For this reason, it provides its Users with a procedure for anonymously reporting violations or abuses. Personal data

  1. By registering on the Portal or visiting it, the User consents to the processing of personal data necessary to use the selected functionality of the Portal. Providing this data is not mandatory, although it may condition the conclusion of the contract.
  2. The data administrator is the owner of the Portal, on whose behalf the Organizer acts as a processor.
  3. Users' personal data within the European Union are processed in accordance with applicable regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
